1. Introduction
These Terms and Conditions govern your use of this website and any purchases made through it. By accessing this website or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the website.

By using this website and placing orders, you confirm that you are at least 18 years of age and have the legal capacity to enter into binding contracts. If you are acting on behalf of a company or other legal entity, you confirm that you have authority to bind that entity to these terms.

3. Definitions
In these Terms and Conditions:

“CPA” means the Consumer Protection Act 68 of 2008;
“ECTA” means the Electronic Communications and Transactions Act 25 of 2002;
“goods” means any items offered for sale on this website;
“we”, “us”, “our” refers to Heir Enterprises Proprietary Limited;
“you”, “your” refers to the person using this website or placing an order;
“website” means www.houseofheir.co.za.

4. Products and Descriptions
All items offered for sale are described as accurately as possible, including any pre-existing condition issues such as minor scratches, wear, or other characteristics. Due to the nature of luxury goods, minor variations in colour, texture, or condition may occur and do not constitute defects.

All measurements provided are approximate.

Important: Each item listing includes a detailed description of the item’s condition. Any characteristics disclosed in the item description (including minor scratches, wear marks, or other pre-existing conditions) are not considered defects and do not form a basis for return.

5. Authenticity
All items sold are guaranteed authentic. Each piece is carefully sourced and inspected prior to sale. If any item is proven to be counterfeit or not as described, we will provide a full refund including any delivery costs paid.

6. Pricing
All prices displayed on this website are in South African Rand (ZAR) unless otherwise indicated. Prices include Value Added Tax (VAT) where applicable. Delivery costs are included in the product price. We reserve the right to change prices at any time, but changes will not affect orders that have already been accepted.

7. Orders and Payment
Orders are subject to acceptance and availability. We will confirm acceptance of your order by email. Payment must be received in full before an order is dispatched.

We accept the following payment methods: credit card, debit card, EFT, and Yoco. All payments are processed through secure, encrypted payment systems that comply with industry standards.

We reserve the right to refuse or cancel any order at our discretion, including where we are unable to verify payment or delivery information. If we cancel an order after payment has been received, we will refund the full amount within 30 days.

8. Order Process
Before you submit your order, you will be given an opportunity to review your order details, including the items selected, quantities, prices, delivery address, and total cost. You may correct any errors or make changes to your order before final submission. You may also withdraw from the transaction at any time before clicking the final confirmation button. Once you click the confirmation button, your order is submitted and you will receive an order confirmation by email.

9. Payment Security
We use industry-standard security measures to protect your payment information, including SSL/TLS encryption for all transactions. Our payment processing is handled by Yoco, which complies with the Payment Card Industry Data Security Standard (PCI-DSS).

10. Delivery
Unless we agree otherwise with you in writing, we will dispatch your order within 30 days of receiving payment. If we are unable to dispatch within this period, we will notify you and you may cancel the order in accordance with clause 11 below.

Delivery Process: Due to the high value and nature of the luxury goods sold on this website, we offer a personalised delivery service. At checkout, you will provide your name, contact information, and delivery address. Delivery costs are included in the purchase price. Following payment and order confirmation, we will contact you directly to arrange a convenient delivery date and time.

Delivery is currently available throughout South Africa. Estimated delivery times will be communicated when we contact you to arrange delivery. While we endeavour to meet these estimates, delivery times are not guaranteed and may be affected by factors beyond our control.

Risk of loss or damage to goods passes to you when you (or someone you have nominated) take physical possession of the goods.

11. Returns, Cancellations and Refunds

  • 11.1 Nature of Luxury Goods
    IMPORTANT NOTICE: The items sold on this website are luxury goods, including pre-owned and new designer handbags. By virtue of their nature and value, these items:
    1. depreciate significantly upon use, handling, or exposure to environmental factors;
    2. may be adversely affected by contact with skin oils, cosmetics, perfumes, or other substances;
    3. cannot be resold at the same value if returned after use; and
    4. require careful handling to maintain their condition and value.

    For these reasons, we apply strict return conditions as set out below.

  • 11.2 Cooling-Off Period
    In terms of section 44 of the Electronic Communications and Transactions Act, you have the right to cancel your purchase and return the goods without reason within 7 days after the date you receive the goods, subject to the following conditions:
    1. The item must be completely unused. This means the item has not been worn, carried, or used in any way, including for a single occasion or event.
    2. The item must be returned in the exact condition in which it was delivered, including all original packaging, dust bags, authenticity cards, and any other accessories provided.
    3. The item must show no signs of use, wear, or handling, including no scratches, marks, odours (including perfume, smoke, or food), stains, or any deterioration from the condition at delivery.
    4. You must notify us in writing (by email to alexa@houseofheir.co.za) within the 7-day period of your intention to return the item.

    You will be responsible for the cost of returning the goods to us. We will refund the purchase price (excluding original delivery costs) within 30 days of receiving the returned goods in acceptable condition.
    Inspection: Upon receipt of a returned item, we will inspect it to verify that it meets the return conditions above. We reserve the sole discretion to determine whether an item has been used or is in acceptable condition for return. If an item is returned in a condition that does not meet these requirements, we may reject the return and return the item to you at your cost.

  • 11.3 Items Not Eligible for Return Under the Cooling-Off Period
    The cooling-off period does not apply to:
    1. goods made to your specifications or clearly personalised;
    2. goods which by their nature cannot be returned or are liable to deteriorate or expire rapidly;
    3. items that have been used, worn, or are not in the same condition as when delivered;
    4. items returned without original packaging or accessories.
  • 11.4 Defective Goods
    If goods are defective or not of good quality, you have the rights set out in clause 12 below (Consumer Rights).
    What is NOT a defect: A defect does not include any characteristic or condition that was disclosed in the item description at the time of sale. For pre-owned items, disclosed characteristics may include minor scratches, wear marks, patina, or other signs of previous ownership. These are not defects and do not entitle you to a return or refund.
  • 11.5 Cancellation for Non-Delivery
    If we have not dispatched your order within 30 days (or such other period as we have agreed with you), you may cancel your order by giving us 7 days’ written notice. Upon cancellation, we will refund all amounts paid within 30 days.
  • 11.6 Unavailability of Goods
    If we are unable to fulfil your order due to the unavailability of the goods ordered, we will notify you immediately and refund all amounts paid by you within 30 days of such notification.

12. Consumer Rights
If you are a consumer as defined in the Consumer Protection Act 68 of 2008, you have certain statutory rights that cannot be excluded by these terms, including:

  1. Right to quality goods: You have the right to receive goods that are reasonably suitable for their intended purpose, of good quality, in good working order, and free from defects (subject to disclosed pre-existing conditions for pre-owned items).
  2. Implied warranty: Within 6 months after delivery, if goods fail to meet the quality standards in clause 12.1 and this was not caused by misuse, accident, or a condition disclosed at the time of sale, you may return the goods and choose between: (a) repair of the goods; (b) replacement of the goods; or (c) a refund of the purchase price.
  3. To exercise these rights, please contact us using the details in clause 2 with proof of purchase and a description of the defect.

13. Sourcing Requests
Private sourcing requests are handled on a best-effort basis. We do not guarantee availability, timelines, or pricing for sourced items.

14. Intellectual Property
All content on this website, including text, images, logos, and design elements, is the property of the company and may not be copied, reproduced, or used without prior written consent.

15. Limitation of Liability
IMPORTANT NOTICE: PLEASE READ THIS CLAUSE CAREFULLY. IT LIMITS OUR LIABILITY TO YOU.

  1. To the extent permitted by law and subject to clause 15.2 below, we are not liable for any indirect, incidental, special, or consequential damages arising from the use of this website or the purchase of any product, including loss of profit, loss of data, or business interruption.
  2. Nothing in these terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) gross negligence; or (d) any liability that cannot be excluded or limited by law, including liability under the Consumer Protection Act.
  3. Our total liability to you for any claim arising out of or in connection with these terms or your use of the website shall not exceed the amount paid by you for the relevant goods or services.

16. Privacy
Your personal information is handled in accordance with our Privacy Policy.

17. Governing Law and Disputes

  1. These Terms and Conditions are governed by the laws of the Republic of South Africa.
  2. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the Western Cape High Court, sitting in Cape Town.
  3. Nothing in this clause limits your rights under the Consumer Protection Act, including your right to approach the National Consumer Commission or Consumer Court.

18. Changes to Terms
We may update or modify these Terms and Conditions from time to time. Material changes will be notified by posting the updated terms on this website with a notice of the changes, or by email if you have provided us with your email address. Changes will not apply to orders already placed before the changes take effect. Your continued use of the website after changes are posted constitutes acceptance of the modified terms.
The date of the last update is displayed at the top of these Terms and Conditions.

19. General

  1. Entire Agreement: These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of this website and any purchases made through it.
  2. Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  3. No Waiver: Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.
  4. Assignment: We may assign or transfer our rights and obligations under these terms without your consent. You may not assign your rights or obligations without our prior written consent.
